TERMS OF SERVICE

These Terms of Service (“Agreement”) are between you (“You,” “Your,” or “User”) and Full Realty Services Inc. DBA Century 21 Masters, a California corporation (“Company,” “we,” “us,” or “our”) and govern your use of our website located at C21masters.com, our real estate services, and all content and services provided in connection therewith (collectively, the “Services”).

1. ACCEPTANCE OF AGREEMENT

By accessing our website, using our Services, or clicking “I Agree,” you:

  • Agree to be bound by this Agreement
  • Represent that you are at least 18 years old
  • Warrant that you have the legal authority to enter into this Agreement
  • Agree to provide accurate and complete information
  • Acknowledge that your use of our Services will comply with this Agreement and applicable laws

If you do not agree to these terms, please do not use our Services.

2. DESCRIPTION OF SERVICES

  • Marketing and advertising services for properties
  • Coordination with affiliated service providers

3. MODIFICATIONS

We may modify this Agreement at any time by posting the updated terms on our website. Changes become effective immediately upon posting. Your continued use of our Services after any modifications constitutes acceptance of the revised Agreement. We recommend reviewing this Agreement periodically for updates.

4. USER OBLIGATIONS AND PROHIBITED CONDUCT

Permitted Use

You may use our Services solely for legitimate real estate purposes, including searching for properties, obtaining real estate services, and communicating with our agents.

Prohibited Activities

You agree not to:

  • Provide false, misleading, or inaccurate information
  • Violate any applicable laws, including fair housing laws, anti-discrimination laws, and real estate regulations
  • Use our Services for unauthorized commercial purposes
  • Attempt to gain unauthorized access to our systems or accounts
  • Upload or transmit harmful software, viruses, or malicious code
  • Engage in harassment, defamation, or abusive behavior
  • Infringe upon intellectual property rights of others
  • Use our Services to send spam or unauthorized marketing materials
  • Scrape, copy, or redistribute our content without permission
  • Impersonate others or create false identities

5. YOUR CONTENT AND INFORMATION

Information You Provide

You may provide us with personal information, property details, preferences, and other content (“Your Content”). You represent and warrant that:

  • You have the right to provide all information you submit
  • Your Content is accurate and not misleading
  • Your Content does not violate any third-party rights
  • You will indemnify us for any claims arising from Your Content

License Grant

By providing Your Content, you grant us a non-exclusive, royalty-free license to use, display, and process Your Content solely for the purpose of providing our Services, including property marketing, MLS submissions, and client communications.

6. OUR CONTENT AND INTELLECTUAL PROPERTY

Proprietary Content

Our website and Services contain proprietary content including text, graphics, logos, images, property data, and software (“Our Content”). This content is protected by copyright, trademark, and other intellectual property laws.

MLS and Third-Party Content

Property listings, photographs, and related information are provided by:

  • Multiple Listing Services (MLS)
  • Listing agents and property owners
  • Third-party data providers

You may not copy, redistribute, or use this content outside of our Services without proper authorization from the copyright owner.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website and Services for personal real estate purposes only.

7. THIRD-PARTY SERVICES AND PARTNERSHIPS

Our Services may include or integrate with third-party providers, including:

  • 21st Century Lending: Mortgage and financing services
  • Turbo Insurance Group: Insurance services
  • Century 21 LLC: Franchise brand and systems
  • MLS Systems: Property listing data
  • Technology Providers: Website hosting, analytics, and communication tools

Your use of third-party services is subject to their respective terms and policies. We are not responsible for third-party services or their performance.

8. PRIVACY

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, available at https://c21masters.com/privacy-policy/, which is incorporated into this Agreement by reference.

9. DISCLAIMERS AND WARRANTIES

Service Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Real Estate Disclaimers

  • Market Information: Property values, market data, and analyses are estimates and not guarantees
  • Property Information: Listing information is provided by third parties and may contain errors
  • Investment Advice: We do not provide investment, tax, or legal advice
  • Transaction Outcomes: We cannot guarantee specific results or transaction success

Website Disclaimers

We do not warrant that our website will be:

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability under this Agreement shall not exceed $1,000
  • We are not liable for indirect, incidental, special, or consequential damages
  • We are not liable for lost profits, data, or business opportunities
  • We are not liable for acts or omissions of third parties, including other real estate professionals

This limitation applies regardless of the legal theory and even if we have been advised of the possibility of such damages.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Full Realty Services Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of our Services
  • Your violation of this Agreement
  • Your violation of applicable laws
  • Your Content or information you provide
  • Your real estate transactions

12. TERMINATION

Either party may terminate this Agreement at any time. We may suspend or terminate your access to our Services immediately if you violate this Agreement. Upon termination:

  • Your right to use our Services ends immediately
  • We may delete your account and content
  • Provisions regarding liability, indemnification, and dispute resolution survive termination

13. DISPUTE RESOLUTION

Governing Law

This Agreement is governed by California law, without regard to conflict of law principles.

Venue

Any legal action arising from this Agreement must be filed in the state or federal courts located in Riverside County, California. You consent to the jurisdiction and venue of these courts.

Attorney Fees

In any legal proceeding, the prevailing party is entitled to recover reasonable attorney fees and costs.

14. REAL ESTATE SPECIFIC TERMS

Agency Relationships

  • Real estate agency relationships are governed by separate agency agreements
  • This Agreement does not create an agency relationship
  • Specific duties and obligations of real estate representation are detailed in listing or buyer representation agreements

Fair Housing Compliance

We are committed to compliance with federal, state, and local fair housing laws. We do not discriminate based on race, color, religion, sex, handicap, familial status, national origin, or other protected characteristics.

Licensing Disclosure

Full Realty Services Inc. DBA Century 21 Masters is licensed by the California Department of Real Estate (DRE# 01849354). For questions about our license status, contact the California DRE at www.dre.ca.gov.

15. GENERAL PROVISIONS

Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and us regarding our Services.

Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

Assignment

You may not assign this Agreement without our written consent. We may assign this Agreement at our discretion.

Force Majeure

Neither party is liable for delays or failures in performance due to circumstances beyond their reasonable control.

Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
